Qupon, which is operated by Paradigm Marketing & Advertising LLC, provides daily deals (hereinafter referred to as a "Deal") to our registered members ("Users") via our website ("Site"). The act of accessing or using the Site indicates that Users have read, understood, and agreed to these terms and conditions ("Terms and Conditions"). Any Terms presented on the website or the deal will take precedence over the Terms stated herein:
1. USER WARRANTIES: Users attest to the following: (i) they are at least 18 years old; (ii) they have the legal authority to form a binding agreement with Qupon regarding any Deals secured on the Site; and (iii) they will use the Site in accordance with these Terms and Conditions.
2. USER RESPONSIBILITIES: Users agree to use the Site strictly for personal and non-commercial purposes. Users also agree not to (a) interfere or attempt to interfere with the functionality of the Site or use the Site in a way that negatively impacts the availability of its resources to other Users; (b) use the Site for any illegal activity or in a manner that contradicts these Terms and Conditions; or (c) modify, copy, distribute, transmit, display, perform, replicate, publish, license, create derivative works from or sell any information obtained from the Site.
3. ACCOUNT SECURITY: Users consent: (a) to safeguard their user identification, password and other confidential information linked to their Site account (“Account”); (b) to accept all outcomes arising from their Account use, unauthorized use, or use by others, including minors; (c ) to inform Qupon immediately if they become aware of any unauthorized use of their Account; and (d) that each username and password is assigned to a single user and cannot be shared or transferred.
4. TERMS AMENDMENT: Qupon has the right to revise these Terms & Conditions at its discretion. Such changes will be effective immediately upon posting on the Site. Continued use of the Site, or any materials provided on the Site, after such posting will be deemed as an unconditional acceptance of the revised Terms & Conditions.
5. PRIVACY POLICY: Qupon collects personal information from Users for the purposes of registering Users for the Deal and processing payments once the Deal is activated. The Deal is only activated if the minimum number of Users register for the Deal within the stipulated timeframe. Qupon uses the collected information to: personalize the advertising and content shown on its pages; fulfill User requests for specific products and services; and inform Users about new deals. Qupon will not sell or lease a User’s personally identifiable information. Qupon will only share a User’s personal information under the following circumstances: (i) we have the User’s permission to share the information; (ii) we need to share the User’s information to deliver the requested product or service; (iii) we need to share the information with companies that assist Qupon in delivering a product or service to the User (unless otherwise stated, these companies cannot use the provided personal information beyond what is required to assist us); or (iv) we are responding to court orders or legal proceedings. 6. EMAIL COMMUNICATION: When Users sign up, it is assumed that they agree to receive emails from Qupon for the confirmation and registration of Deals and for receiving information on Deals through the Site's newsletter.
7. RESERVATION CANCELLATIONS: A voucher from the Site is deemed as redeemed once a User has made a booking, reservation, or appointment with the business relevant to the voucher. If a User schedules a booking, reservation, or appointment with a business and fails to attend, the voucher will be consider secure a booking, reservation, or appointment at specific times. The User must arrange a suitable time for a booking, reservation, or appointment directly with the business.
8. DEAL TERMS: Users understand and agree that their acquisition of a Deal from Qupon might be subject to specific terms and conditions that will be disclosed on the Site before the purchase of the Deal. Users agree to adhere to these specific terms and conditions, and acknowledge that in case of any inconsistency between these specific terms and conditions and these Terms and Conditions, the specific terms and conditions will prevail.
9. REFUNDS: Except as required by law, a User is not entitled to a refund if they merely change their mind or make a wrong decision. A User will receive their voucher via email if the Deal they have secured attains its minimum number of purchasers. If a User encounters problems while using their voucher at a business, they can contact us.
10. VOUCHER USE: Users can redeem their vouchers with the corresponding business to receive the goods or services they have acquired through a Deal. Users understand and agree that the business, not Qupon, is the supplier of the goods or services and is solely accountable for honoring any voucher a User has secured. Qupon provides no warranty regarding the standard or quality of any goods or services sold via the Site. All promotional materials related to a business’s goods or services are based on information supplied by the business and its affiliates. Vouchers cannot be exchanged for cash. Qupon is not liable for any vouchers that are lost, stolen, or redeemed by an unauthorized third party. Vouchers must not be resold, offered for resale, duplicated, used, traded, or utilized for promotional, deal, or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services.
11. CONTENT: Users are not granted any rights or licenses to Qupon or materials available on the Site (“Qupon.qa”), other than the limited right to use the Site in compliance with these Terms & Conditions. Users shall not duplicate, display, modify, create derivative works of, publish, or sell Qupon content or any information, software, or services provided by Qupon. The content may be updated from time to time at Qupon's sole discretion. Except as explicitly stated herein, no license is granted to the User for any other purpose, and any other unauthorized, unlawful or fraudulent use of the Site or the Qupon Content by User will constitute a substantial breach of these Terms & Conditions. These Terms & Conditions do not affect any rights of Qupon, its affiliates, or its licensors in the Site or Qupon.qa content, and any associated patents, trademarks, copyrights, designs, trade secrets, or other intellectual property rights in the Site or Qupon.qa content. No license, right or interest in any trademarks of Qupon or any third party is granted under these Terms & Conditions.
12. COPYRIGHT: All material presented on this Site, referred to as “Copyright Material”, is protected by copyright, unless otherwise indicated, and may not be used except as allowed in these Terms & Conditions or in the text on the Site. The Copyright Material is protected under the laws of the State of Qatar and other countries.
13.TRADEMARKS: The Trademarks, or distinctive symbols, visible on the Site, collectively referred to as "Trademarks", are the property of Qupon and/or its affiliates unless stated otherwise. Businesses showcased on the Site periodically provide their own logos and graphics, assuring they possess the rights to display these visuals on our Site. No inference from the Site should be taken as granting, either implicitly or otherwise, any permission or right to use the Trademarks displayed on the Site without express written consent from Qupon or any relevant third-party owner. Any use of Copyright Material and/or Trademarks by any User, or anyone authorized by a User, is forbidden unless expressly permitted by these Terms and Conditions or by Qupon. Unauthorized use of the images could infringe copyright laws, trademark laws, privacy laws, and civil and criminal statutes.
14. HYPERLINKS: The Site may include links to external websites. Qupon does not endorse, control, or assume responsibility for the content of any website linked to or from the Site. Links to other websites are provided for Users' convenience only, and Qupon offers no warranty or representation regarding and does not endorse the owner/sponsor of any such websites or any content available on those websites. Qupon renounces all warranties, explicit and implied, about the precision, legality, validity, or otherwise of any materials or information located on such websites. Qupon does not guarantee nor represent that a User’s use of any materials on linked websites will not infringe the rights of any third parties.
15. NO WARRANTIES: Qupon disclaims responsibility, and will not be accountable for any damage or viruses that may infect a User’s computer equipment or other property on account of the User accessing and/or using the Site or any linked websites, or a User downloading any materials, data, text, images, video, or audio from the Site or any linked websites. Qupon disclaims responsibility for computer systems, hardware, software, or program malfunctions or for other errors, failures, or delays in computer transmissions or network connections or for lost, late, illegible, incomplete, or misdirected information. Users must provide a valid email address. Qupon retains the right, at its sole discretion, to cancel or suspend any Deals or the Site should any virus, bugs, or other causes beyond Qupon.qa’s control corrupts the administration, security or proper function of this Site. Qupon does not guarantee the accuracy or completeness of any material or the reliability of any advice, opinion, statement, or other information displayed or distributed through the Site. Users acknowledge that reliance on any such material, opinion, advice, statement, memorandum, or information will be at their own risk.
16. REVIEW OF POSTINGS & UPLOADS: Users may send and receive electronic mail, participate in discussions, download (and potentially upload) files, and use this Site in other ways permitted by these Terms and Conditions, the operational policies of Qupon, and applicable law. Users' participation in online communications and communities happens in real-time and is not edited, censored, or otherwise controlled by Qupon. Qupon does not and cannot review all communications and materials posted or uploaded to the Site and is not liable for the content of these communications and materials, nor for errors, defamation, libel, obscenity, profanity, or inaccuracy contained in any such communication or materials. Qupon reserves the right to block or remove communications or materials that it deems, at its sole discretion, to be (a) abusive, libelous, defamatory or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright or trademark, or other intellectual property right of another (d) encouraging conduct that could be considered a criminal offense or give rise to civil liability or otherwise violate any law (e) offensive or otherwise unacceptable; or (f) harmful, offensive or otherwise in violation of these Terms & Conditions or the operating policies of Qupon. Qupon may disclose the identity of anyone posting such communications or materials when required by law or requested by any law enforcement authorities or by court order. Statements made in websites, newsgroups, message boards, email, forums and chats reflect only the views of their authors, and do not necessarily reflect those of Qupon.
17. REGISTRATION: To gain access to the Deals offered by Qupon on the Site, Users must register by completing their registration details as described on the Site. Qupon retains the right to terminate a User’s membership at any time if that User violates these Terms and Conditions. Users must ensure that their registration details are accurate and current at all times. Specifically, Users must nform Qupon of any changes to their registration details. Upon registration, Users must nominate a username and password.
18. TERM AND TERMINATION: Either Users or Qupon may terminate a User’s Account at any time, with or without cause, upon notice. Provisions 1, 2, 3, 4, 5, 9, 10, 11, 12, 13, 14, 15, 16, 18, 19, 20, 21, 21, 23, 24, 25 will remain in effect even after any termination of these Terms and Conditions.
19. ACCOUNTABILITY: Qupon, its subsidiaries and affiliated entities are not accountable (to the extent permissible by consumer protection laws) for any damage, loss, injury, or death (including, but not limited to, indirect, direct or consequential losses) experienced or sustained in relation with: (i) any inaccurate or incorrect information provided by a business on the Site; (ii) any usage of the Site or Qupon Content; (iii) any usage of the Deals offered by Qupon, its affiliates or its associated agencies; (iv) any action or inaction (whether negligent or not) of Qupon, its affiliates and its associated agencies or any person associated with any of them; (v) any failure or delay including, but not limited to, the use or inability to use any component of the Site for reservations; or (vi) the performance or non- performance of any business in connection with a Deal. Any liability that cannot be excluded by law will, at the discretion of Qupon and as far as the law allows, be restricted to: (a) in relation to goods: (i) repairing or replacing those goods; or (ii) covering the cost of having those goods repaired or replaced; and (b) if the breach pertains to services: (i) resupplying those or equivalent services; or (ii) covering the cost of having those services resupplied.
20. RELEASE OF LIABILITY AND INDEMNIFICATION: Every User hereby discharges and releases, and agrees to indemnify, Qupon and its directors, officers, employees, agents and affiliates (“Released Parties”), from any personal injury, illness or death, claims, liabilities or expenses of any kind, including reasonable attorney’s fees (and whether accruing to the User, their heirs or personal representatives) that are caused or alleged to be caused in whole or in part by reason of an act or omission of any Released Party that arises out of or in connection with: (i) the User’s use of the Site; or (ii) resulting from any violation of these Terms & Conditions or any terms & conditions specified by a business; or (iii) any activity related to the User’s Account (including infringement of any third parties’ worldwide intellectual property rights or negligent or wrongful conduct); or (iv) by the User or any other person accessing Qupon using the User’s Account.
21. THIRD-PARTY RIGHTS: The preceding provisions regarding Indemnification, Release and Limitation of Liability are for the benefit of Qupon and its affiliates, officers, directors, employees, agents, licensors, suppliers and information providers. Each of these individuals or entities has the right to assert and enforce those provisions directly against a User on its own behalf.
22. INTERNATIONAL USE: Qupon makes no claim that the content of the Site is appropriate or available for use outside the State of Qatar. Users choosing to access the Site from outside Qatar are responsible for compliance with foreign and local laws.
23. JURISDICTION: These Terms & Conditions are governed by and construed under the laws of the State of Qatar. Each party unequivocally and unconditionally submits to the non-exclusive jurisdiction of the courts of the State of Qatar.
24. SEVERABILITY: If any part of these Terms & Conditions, or any section thereof, is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to fulfill the intent of the Terms & Conditions, and the remainder of these Terms & Conditions shall continue in full effect.
25. NO TRANSFER: Users may not transfer, delegate or assign these Terms & Conditions and the rights and obligations hereunder in any way.
26. MISCELLANEOUS: Any failure by Qupon to enforce strict compliance with any provision of these Terms & Conditions should not be interpreted as a waiver of any provision or right. Neither the course of conduct between the parties nor industry practice will act to alter any provision of these Terms & Conditions. Qupon may assign its rights and obligations under these Terms & Conditions to any party at any time without prior notification to Users.
